PRIVACY POLICY

Hypelist, LLC (referenced herein as “Company,” “Hypelist,” “we”, “us,” or “our”) has developed this privacy policy statement (“Privacy Policy”) to assist end users of our application and/or visitors of our website (referenced herein as “you” or “your” or “their” or “user”) in understanding the Company’s collection and use of information that can be used to identify you (“Personal Information”) in connection with the Company’s application, website www.hypelist.com, and any other website, social media pages, app, or other digital medium owned or operated by Hypelist (collectively, the “App”). This Privacy Policy applies to any Personal Information collected, stored, or used by us, such as information you provide us through the above media or by email, mail, or telephonic communications in connection with our App, and any and all products or services provided to you by Hypelist (together, “Services”).

 

Hypelist takes your privacy seriously. When you use our Services, you provide Personal Information. Additionally, the photos, videos, messages, gifs, lists, groups, preferences, and other forms of communication that you share on your account through the App and our Services may be shared with other users. This Privacy Policy helps explain what Personal Information we collect, how we utilize it, and the access to such by third parties. Furthermore, this Privacy Policy describes your data protection rights, including the right to object to some of the processing activities which the Company carries out. More information about your rights, and how to exercise them, is set out in Section “Your Rights’”.

By accessing or using our App or Services, you acknowledge and consent to the Terms of Use (“Terms”) and this Privacy Policy, including our collection, use, and disclosure of your Personal Information as described herein, and to the extent such acknowledgement and consent by you is made on behalf of any other individual, entity, or organization, you should only do so with the authorization and consent of such other individual, entity, or organization. This Privacy Policy is not a contract and does not create any legal rights.

 

Hypelist reserves the right to update this Privacy Policy at any time to address changes to its Personal Information collection, use, or disclosure practices or changes in law. If Hypelist makes changes to this Privacy Policy, we will post those changes in connection with its App and/or Services so that you are aware of what Personal Information we collect, how we use it, and under what circumstances, if any, we disclose it. We may also provide notice of material changes using contact information you provide to us. Hypelist will also update the updated and effective date referenced in this Privacy Notice. We will treat your continued use of this App or our Services following such updates as your acknowledgement and acceptance of the changes. Please review this Privacy Policy carefully on a periodic basis.

 

Personal Information We Collect:

We gather various types of your Personal Information when you utilize our Services. This Privacy Policy does not cover data we, or our authorized third-party vendors or partners, collect that cannot be used to identify an individual, . We get most Personal Information directly from you, through the App, or from transactions with you in connection with our Services. We might also obtain Personal Information about you from other App users or other entities with whom we have contact. For example, we may obtain Personal Information through public records, or transactions you have with our authorized third-party vendors or partners. If you are sharing information with us about any other individual, you must obtain their consent. The categories of Personal Information we may collect from you include:

·         Contact Information: first name, last name, date of birth, gender, images, email address.

·         Search History: data generated through your use of our App or Services, searched items, preferences.

·         Usage Data: details of how you use our Services, login data, browser information, time zone setting, and location and operating system of your device(s) used to access our Services.

·         User Content: your interests, posts, groupings, comments, messages, photos, videos shared to the App or via the Services.

·         Identifiers: username, profile photos, groups, IP address, preferences.

·         Diagnostics: error messages, ticket information, usage rates.

·         Location: general geographical location where you are located (if you have enabled this feature on your device). User location information is collected, but not connected to your identity.

Additionally, for some aspects of our App, we may also collect and maintain Personal Information about you to create a personal profile containing preferences and other information that you voluntarily provide to us, including Personal Information (“Account”). In doing so, or in connection with our Services generally, you may need to represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent (as applicable) to allow any of your minor dependents to use the App. You may be able to update, correct, or delete information about you via your Account, by updating your profile information via the Services, or by emailing us at hello@hypelist.com. If you wish to delete your Account or, under appropriate circumstances, Personal Information that may have been collected, please email us at hello@hypelist.com, but note that we may require further confirmational procedures and necessarily retain certain information about you for legitimate business purposes or as required by law. Examples of the types of information we may collect for this purpose include your first and last name, a valid email address, user data, and/or geographic location or address. Additionally, we may use your email address to send confirmation of Services, special offers, promotions, upcoming events, or matters may be of interest to you.

 

You are not obligated to furnish Personal Information to us. Nevertheless, there could be situations where we require Personal Information for the provision of our Services or to adhere to relevant laws. In such instances, failure to provide the necessary information may result in restrictions to your access to our Services, including your ability to fully access our App, participate in our Services, receive our updates or correspondence, or similar features.

 

How We Use Your Personal Information. In accordance with applicable privacy laws, this Privacy Policy generally describes how we use your Personal Information. In addition, Personal Information is used by Hypelist in connection with the following categories of general purposes:

1.     Personal and Contact Information: Hypelist may use your Personal Information to provide Services and, in particular, facilitate the education, community, and networking capabilities of the Services, including in connection with artificial intelligence (“AI”) models and content; advertise its Services or the goods and services of its members and third parties; create a personalized experience for you; provide you with news and information; and get in touch with you when necessary with respect to transactions conducted through the Services, material changes in our policies and agreements, and new products, tools, or services Hypelist may offer. Hypelist may also share your Personal Information with Company members, agents, service providers, affiliates, or business partners, as is necessary to provide Company Services and information; for advertising purposes; and to host, operate, or facilitate transactions through the Services, including, without limitation, registration for membership, events, or for internal business purposes. In addition, Hypelist may supplement the Personal Information collected from you with information from other sources, such as from business partners, third-parties, or publicly available sources, in order to enhance the Company’s ability to provide or advertise its Services or those of other entities or to otherwise tailor, manage, improve, or operate the Services.

2.     Demographic Information: Hypelist may share demographic data on an aggregated basis, which will not identify any particular user, with Company members, agents, service providers, partners, and affiliates, and for advertising or other technical or business purposes.

3.     Survey Results: Hypelist may share survey results collected through the Services with its business partners, agents, service providers, members, and affiliates, and/or the general public, the news media, and with federal government and state governments—not only for business or marketing purposes or as may be required by law, but also to participate in government programs and initiatives.

4.     Technical Information: Hypelist may use Personal Information to facilitate educational opportunities, participation, or otherwise allow access to or use of certain information, tools, or features, and for improving the App or Services performance, usability, and design. Hypelist may also use technical information to help diagnose problems with Company servers or Services, analyze App or Services usage trends, track user movements on the App, and to otherwise manage, improve, and monitor the Services.

5.     Business Transfers: Your Personal Information may be transferred to another entity (either an affiliated entity or an unrelated third-party) in connection with a merger, reorganization, dissolution, or similar corporate event. In the event a transaction of this kind occurs that results in the transfer of Personal Information, Hypelist may notify you via email and/or place a prominent notice on the App or in connection with the Services in connection with any such change in ownership or control and the possible changes to this Privacy Policy.

6.     Government and Legal Disclosures: We may disclose Personal Information when legally required to do so in accordance with government requests, regulations, or legal proceedings. Hypelist may also disclose Personal Information to protect against misuse or unauthorized use of the Services or as is otherwise required to limit legal liability, or to protect or defend the rights, property, or safety of the Company, Company users, or others.

We will work to ensure that any third parties to whom we may disclose Personal Information will be consistent with this Privacy Policy. Those additional privacy policies will govern use, handling, and disclosure of your Personal Information once we have shared it with those third parties as described in this Privacy Policy. If you want to learn more about third-party privacy practices, we encourage you to visit the websites of those third parties. These entities or their servers may be located either inside or outside the United States.

 

Categories of Personal Information Disclosed or Sold

 

We do not sell your Personal Information to any third parties. In the preceding twelve (12) months, we did not sell any categories of Personal Information.

 

Personal Information may be collected by, disclosed to, and/or shared with us, other users, and/or the general public when you affirmatively provide optional data to the App or Services directly and in connection with your name or username for app functionality, personalization, or analytics.

 

Additionally, in order to conduct our business and better serve you, we may disclose Personal Information and other information about you or your activities on our App or while using our Services with:

 

·         Our affiliates.

·         Our service providers and vendors, such as payment processors, promotional partners, website hosts, analytics providers, legal counsel, and various customer, technology, and operational support.

·         Third parties approved by you, such as social media sites.

·         Financial and legal institutions.

·         Law enforcement agencies, regulatory bodies, courts, or other public authorities, to comply with our legal and regulatory obligations, in response to a subpoena or similar investigative demand, to respond to requests from governmental authorities, to establish, exercise, or protect our rights, to defend against legal claims, or as otherwise required by law. In such cases, we may raise or waive any legal objection or right available to us, in our sole discretion.

·         Other situations when we believe disclosure is appropriate in connection with efforts to investigate, prevent, report, or take other action regarding illegal activity, suspected fraud, or other wrongdoing; to protect and defend the rights, property, or safety of our company, our users, our employees, or others; to comply with applicable law or cooperate with law enforcement; or to enforce the Terms that apply to our App or other agreements or policies.

 

Some third-party providers may independently collect Personal Information when you access our Services. Our authorized third-party vendors and partners have their own privacy notices which govern the use, handling, and disclosure of your Personal Information.

 

Children’s Privacy. Hypelist cares about the safety of children on the App or in connection with the Services and encourages parents and guardians to monitor their children’s use of the Internet. We do not knowingly collect information directly from minors. If you are a parent or guardian and believe that your child under the age of sixteen (16) has provided Personal Information directly to us without your consent, please notify us at hello@hypelist.com. If we become aware that information is or has been submitted by or collected directly from a minor under the age of sixteen (16), we will work to promptly delete this information.

 

Cookies & Computer-Related Information / About Our Ads. Hypelist or its contractors may use cookies, web beacons, tags, log-in files, and/or other similar data collection or tracking techniques that are placed in your browser and allow us to identify new visitors and to recognize you each time you access the Services, to integrate with third parties, including social media sites, to enhance and/or monitor your experience with interest-based or targeted advertising, to observe your behaviors and browsing activities over time across multiple websites or other platforms, and to better understand the interests of our customers and visitors.

 

Cookies and other related techniques are generally pieces of information, which Hypelist uses for record-keeping purposes and which the Services may transfer to us and/or your computer’s web browser for storage on our server(s) or your computer’s hard drive. Cookies and other related techniques enable the Company to manage and/or customize your experience in connection with the Services, including available advertisements. Cookies and other related techniques also make online surfing or app/site review easier by automatically performing certain functions such as saving your personal preferences and by providing targeted content. Hypelist, however, will not use cookies to record passwords or credit card or other financial information. Many consider the use of cookies and such identifiers to be an industry standard measure. Consequently, your web browser is likely set to accept cookies or allow other identifiers.

 

Using cookies and similar techniques, we may automatically receive and store certain types of Personal Information whenever you visit the App, such as information from Google Analytics (see https://policies.google.com/privacy), on when, how often, and for how long you use the App, information related to your geographic location, and the content you submit and view. This information may be in aggregated / anonymized formats, and/or may include the name of the domain and host from which you access the Internet and the IP address of the computer or device you are using. We may log and use your IP address to administer or improve the Services, to help diagnose problems with our server, to analyze trends, to track users’ webpage movements, to help identify you and/or verify your use, and to gather broad demographic information for aggregate use. We may use standard tools, such as cookies or web beacons, to monitor the Services and Internet usage and to improve or customize the content of the Services, including advertisements. You may be able to control the use of cookies with respect to your own devices by changing your own browser settings.

 

Our web servers may also collect usage or log data, which provides aggregate information about the number of visits to different content via the Services. We use such aggregate log data to improve access to the Services based on visitors’ web browsers and operating system types to make the Services available to as many users as possible. We do not link the log data collected to Personal Information. Third party providers may also collect aggregate log data independently from us.

 

If you would prefer not to receive cookies or allow identifiers, however, you may be able to alter the configuration of your browser to refuse cookies or browse anonymously. In order to facilitate this, you should follow the instructions provided by your browser or device. Certain browsers can be set to reject browser cookies. Certain choices you make are both browser and device-specific, and are deleted whenever you clear your browser’s cache. If you block or reject cookies, not all of the tracking described here will necessarily stop. If you choose to have your browser refuse cookies or browse anonymously, you should understand that it is possible that some aspects of our Services will not function properly when you view them. For example, we may not recognize the device you are using and you may need to log in every time you use the Services, or similar features.

 

Do Not Track. We do not currently respond to Do Not Track or Global Privacy Control browser settings because a uniform technological standard has not yet been developed, and we do not have control over other sites’ use or acceptance of Do Not Track browser settings or the Global Privacy Control signal. We reserve the right to update our practices and Privacy Policy as such standards evolve.

 

The Self-Regulatory Program for Online Behavioral Advertising program provides consumers with the ability to opt-out of having their online behavior recorded and used for advertising purposes. Your Choices. We may use the Personal Information we collect about you to provide requested information or materials or to offer you products and services that may be of interest to you by email. Where required under applicable laws, we collect your consent in order to send you promotional materials. If you would like to opt out of future promotional materials from us, you may indicate this preference by following the unsubscribe instructions at the end of such emails or by contacting us at hello@hypelist.com. Opt-out requests may not be able to be immediately processed and we may continue to send you other types of transactional email communications (e.g. to inform you about the Services requested).

 

You also may be able to log into your own Account to view, amend, or delete Account information, including Personal Information. Please note that while changes or deletions to an Account or Personal Information may be reflected promptly in the active user database, our servers or our associated third parties may retain previously provided information, and may be required to keep certain information or not delete it, or keep information for a certain period of time.

 

Any changes to, or deletion of, Account information does not affect any other information collected by us, or which we may retain and continue to use or disclose in accordance with this Privacy Policy. If we already provided your Personal Information to a third party before you changed your preferences or updated your account, you may need to change your preferences directly with that third party.

 

Data Security. We restrict access to Personal Information to those who need to know in order to provide Services to you and to conduct our internal operations. We have implemented commercially reasonable technical and organizational security measures to protect Personal Information that you submit to us and that is under our control against accidental loss, unauthorized access, misuse, disclosure, or alteration. Please be aware, however, that no method of data transmission over the Internet, or method of electronic data storage, is 100% secure. Therefore, while we strive to protect your Personal Information, we cannot guarantee the absolute security, integrity, and privacy of any or all information exchanged between you and us through the Services. As applicable, we will comply with notification requirements for a security breach and may also notify you using the email address you have provided to us. We make no warranty—express, implied, or otherwise—that we will prevent unauthorized access to or use of your Personal Information. If you do not agree to the collection, processing, storage, and transfer of your Personal Information, please do not provide your Personal Information or use Hypelist’s Services.

 

Data Retention Period. We will retain your Personal Information for as long as is reasonably necessary for our business operations and to fulfill the purpose of collection or further processing as described in this Privacy Policy; as we determine is necessary for business records; and to comply with applicable law. Your Rights

 

Under state or international law, you may have certain rights. Please read below for the rights that apply to residents of certain jurisdictions.

 

Residents of California

 

As we do not sell your personal information, there is no need to submit a request to opt-out.

 

We will not disclose your Personal Information to third parties for them to use for their direct marketing purposes unless you agree to us making that disclosure.

 

“Do not track”: Section 22575 of the California Business & Professions Code requires website and online service operators to disclose whether they honor web browser “Do Not Track” settings. Some browsers incorporate a “Do Not Track” (DNT) feature that, when turned on, signals to websites and online services that you do not wish to be tracked. Because there is not yet an accepted standard for how to respond to browser DNT signals, we do not currently respond to them. “Shine the Light” law: Effective January 1, 2005, under California Civil Code Section 1798.83, if an individual who is a California resident has provided Personal Information to a business in connection with a business relationship that is primarily for personal, family, or household purposes, and if that business has within the immediately preceding calendar year disclosed such an individual’s Personal Information to a third party and knows or should have known that such third party used the information for its own direct marketing purposes, then that business is obligated to disclose in writing to such individual upon request, what Personal Information was shared and with whom it was shared.

 

Additionally, you may have the following rights:

 

         The right to correct inaccuracies in your Personal Information in our possession.

         The right to request we delete Personal Information we have collected about you.

         The right to request that we disclose the specific pieces of Personal Information we have collected about you.

         The right to request the categories of Personal Information we have collected about you; the categories of Personal Information we sold or shared about you; the categories of third parties to whom the Personal Information was sold or shared, by category of Personal Information; the categories of Personal Information we disclosed about you for a business purpose; and the categories of third parties to whom we disclosed Personal Information for a business purpose.

You have the right to not be discriminated against for exercising any of these rights. Any request for a disclosure required under this California law should be sent to us as indicated below in the Contact Us section below. Please note that under this law, we are not required to respond to your request more than once in a calendar year, nor are we required to respond to any request that is not sent to the email or mailing address designated above.

 

Residents of Nevada

Users from Outside the United States

 

Our App is hosted in the United States and our Services are governed by United States law. If you are using the Services from outside the United States, please be aware that your Personal Information may be transferred to, stored, and processed in the United States where our servers are located. The data protection and other laws of the United States and other countries might not be as comprehensive as those in your country.

 

As described in this Privacy Policy, we will only use (process) your Personal Information if you have given us consent to do so, it is necessary to fulfill a contract, or it is necessary for a legal obligation. When we have a legitimate interest to process your personal information. Our legitimate interest will vary depending on what we are processing your data for, and we explain above what the interest is and how it relates to the processing operations that we are carrying out. Where we process personal information on the basis of a legitimate interest, we will carry out a balancing test to document our interests, to consider what the impact of the processing will be on you and to determine whether your interests or fundamental rights and freedoms outweigh our interests in the processing taking place. When we transfer your personal information to other countries, such as [add relevant countries], we will protect that information as described in this Privacy Policy and in accordance with applicable law. We use contractual protections for the transfer of personal information among various jurisdictions, including, for example, the European Commission's standard contractual clauses, (read more here) (in most cases we use module 1 – controller to controller and module 2 – controller to processor) and the Binding Corporate Rules that some of our suppliers have adopted (read more here). To deliver Services to you, it may also be necessary for us to transfer your Personal Information to the United States.

         The right to request access to your Personal Information in our possession.

         The right to erasure (deletion) or of certain restriction of processing of your Personal Information in our possession.

         The right to withdraw your given consent to process your Personal Information for a specific purpose (e.g. to send you direct marketing communication). This will not affect the lawfulness of any processing carried out before you withdraw your consent.

 

These rights may be limited, for example if fulfilling your request would reveal personal information about another person, or if you ask us to delete information which we are required by law or have compelling legitimate interests to keep. In the European Union, you may also have the right to file a complaint with a supervisory authority in the country that you reside in or the country of your place of work or the country where the alleged infringement took place.
